Millions of air passengers travel each year, but a large number do not realize that there are air passenger rights to protect them while in transit. AirHelp can explain your rights, and help you claim the compensation you’re entitled to.
As a passenger, the cancellation of your flight may result in the delay of your trip, in which case the legislation entitles the passenger to demand from the airline to pay flight compensation of up to 600 euros. However, it should be noted that the airline is obliged to pay flight compensation only when a number of conditions are met, which you will see in more detail below.
In what case are you entitled to compensation for a canceled flight?
In order to receive compensation for a canceled flight, several conditions must be met:
The airline did not notify you 14 days before the flight cancellation
You showed up for registration on time
The reason for the flight cancellation was within the airline’s control, for example: operational circumstances, technical malfunction, staff strike, etc.
If the airline notified the passenger about a delayed flight less than 14 days before, the passenger may be entitled to compensation of between 250 and 600 euros, even if the airline reimbursed the passenger for the ticket price paid for the canceled flight. How is the amount of compensation for a canceled flight calculated?
The amount of flight compensation depends on the distance between the airport of departure and the airport of final destination and is determined as follows:
Distance up to 1500 km – 250€
Distance up to 1500-3500 km – 400€
Distance more than 3500 km – 600€
Please note that the reasons listed above are general and may require additional clarification based on the specifics. You can quickly check whether you are entitled to flight compensation in our online application or please write to us in detail about your case.
It does not matter the price of the purchased airline ticket. The passenger is entitled to the flight compensation regardless of the price.
The airline is not obliged to pay the passenger flight compensation if:
The airline notified the passenger about the flight delay within two weeks
The flight was delayed due to “extraordinary circumstances” that the airline could not avoid
Extraordinary Circumstances
Note that the airline is not obligated to pay flight compensation to the passenger if the flight is delayed/cancelled due to “extraordinary circumstances” that the airline could not have avoided. Generally, “extraordinary circumstances” include cases beyond the Airline’s control and which the Airline cannot prevent. There is no specific list of “extraordinary circumstances” and it must be determined on a case-by-case basis. At the same time, the scope of “extraordinary circumstances” may always be changed/updated based on the precedent decisions of various courts. In general, the following are considered “extraordinary circumstances”:
Bad weather makes the flight impossible
Political or civil unrest
Bird collision with plane
Security related risks that do not depend on the airline
Government decisions
Any other circumstances beyond the Airline’s control
What should I do if my flight was delayed?
Ask the airline representatives for an explanation regarding the reason for the flight delay
Keep the travel documents (boarding pass, e-ticket, voucher provided by the airline, alternative airline ticket, etc.)
Provide information about possible flight compensation to other passengers
Contact us, tell our team about your problem in detail and send copies of travel documents
You should also know that:
It doesn’t matter whether you purchased the airline ticket or with the help of a travel agency, you are still entitled to the flight compensation
If you were traveling to a business meeting and the airline ticket was purchased by the company, you are the affected one. Therefore only you are entitled to claim compensation
Regardless of the airline ticket price, you can request compensation in any case
